These terms are an agreement between you and DesignButter LLC, which runs GetAwayyy ("GetAwayyy", "we", "us"). By signing up for our emails or using getawayyy.com, you agree to them. If you do not agree, please do not use the service.

1. What GetAwayyy is

GetAwayyy is a free email alert service. We keep a private list of unusual places to stay and things to do in the United States, watch the prices those suppliers publish, and email you when one drops. That is the whole service.

We are not a travel agency, tour operator, booking site, or seller of travel. We do not hold inventory, take payment, or make reservations. Every booking happens on the supplier's own website, under the supplier's own terms.

2. Who can use it

You must be at least 18 years old to subscribe. By signing up you confirm that the email address is yours, or that you have permission to use it, and that you want to receive our alerts.

3. Prices and deals

We work hard to send only real deals, and we check every price before we send. Even so:

• Every price we send was shown by the supplier on the date in the email, for the specific dates and group described. Prices change, sometimes within hours, and can sell out at any time.
• A crossed-out price is a price we recorded from the same supplier for the same thing on an earlier date, or the supplier's own published regular price. We do not invent list prices.
• The supplier's website sets the final price, availability, taxes, fees, deposit, and cancellation rules. Confirm everything there before you book.
• Our descriptions of places come from the supplier's own materials and public sources. We do not inspect properties and cannot guarantee their condition, amenities, or suitability for you.

We make no promise that any deal will still be available when you read the email, that a price is the lowest available anywhere, or that a place will meet your expectations.

4. Suppliers are not us

The hotels, ranches, outfitters, parks, and other businesses we write about are independent. We do not control them, we are not their agent, and they are not ours. Your booking, your stay, and any dispute about either are between you and the supplier. We are not responsible for a supplier's acts, omissions, errors, cancellations, or failures.

5. Affiliate links and compensation

We do not currently receive commissions or payment from suppliers. If we ever add affiliate links, we will disclose that in the email containing the link. Compensation will never change the price you pay or which deals we choose to send.

6. Email and unsubscribing

By subscribing you agree to receive alert emails and occasional service notices from us. We send alerts only when we find a real price drop, not on a schedule. You can unsubscribe at any time with the link in every email, and we honor it immediately. You can also change your preferences through the link in every email.

7. Your responsibilities

You agree not to:

• Sign up email addresses that are not yours or that you do not have permission to use.
• Use automated tools to sign up, scrape, or overload our site.
• Copy, republish, or resell our alerts, deal pages, or the list of places we watch, beyond sharing an individual deal with friends and family.
• Interfere with the service or try to access data that is not yours.

8. Our content

The GetAwayyy name, logo, site design, alert format, and written content are ours. Photos of places belong to the suppliers or photographers credited and are used with permission or under license. You may share links to our deal pages freely. You may not use our name or logo to suggest we endorse you without our written permission.

9. The service is provided "as is"

GetAwayyy is free, and we provide it as is and as available, without warranties of any kind, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, or non-infringement. We may change, pause, or stop the service at any time without notice.

10. Limits on our liability

To the fullest extent the law allows, GetAwayyy and DesignButter LLC, and their owner, will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for lost savings, lost trips, travel costs, or bookings you made or did not make in reliance on an alert. If we are found liable to you for anything connected with the service, our total liability is limited to fifty US dollars ($50). Some states do not allow certain limits, so some of this section may not apply to you.

11. Indemnity

If your misuse of the service or breach of these terms causes a claim against us, you agree to cover our reasonable costs, including legal fees, in dealing with it.

12. Ending the agreement

You can end it any time by unsubscribing. We may remove any subscriber or end the service at any time, with or without notice, for any reason. Sections 3, 4, 8, 9, 10, 11, and 13 survive.

13. Governing law and disputes

These terms are governed by the laws of the State of Utah and applicable US federal law, without regard to conflict-of-law rules. If we have a dispute, you agree to contact us first at the address below so we can try to sort it out. If we cannot within 30 days, any claim must be brought in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction. Any claim must be filed within one year of when it arose or it is waived.

14. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell you by email. Staying subscribed after a change means you accept the new terms.

15. The rest

These terms and our Privacy Policy are the entire agreement between you and us about the service. If any part is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer this agreement; we may transfer it to a successor who takes over GetAwayyy.
